Background: The Supreme Court of Canada has ruled that when HIV+ people do not disclose their status to sex partners they are committing a serious crime (often, aggravated sexual assault) if there is a realistic possibility of HIV transmission. Many HIV+ people have been prosecuted and jailed even if their sex partners did not contract HIV. Efforts are now underway to use prosecutorial guidelines and other tools to criminal law less punitive towards HIV+ people, and updated information on these efforts will be presented at the panel.
